Former Tehelka editor-in-chief Tarun Tejpal surrendered before a Goa court on Monday and was sent to Colvale Central Jail, marking a major turn in the decade-old sexual assault case. His imprisonment follows the Bombay High Court’s decision to overturn his earlier acquittal and sentence him to 10 years’ rigorous imprisonment, while Tejpal has vowed to continue challenging the conviction before the Supreme Court.
Tarun Tejpal, 62, has begun serving his 10-year prison sentence after surrendering before the Additional Sessions Court at Mapusa. Following the formalities, he was taken to Central Jail at Colvale in North Goa.
The surrender came after the Supreme Court directed Tejpal on August 25 to submit himself to custody within two weeks. The apex court declined to grant him immediate relief and made it clear that his appeal against the conviction would be taken up after he furnished a surrender certificate.
Leaving the court premises, Tejpal indicated that his legal battle was far from over. He said he would again approach the Supreme Court and expressed confidence that he would ultimately receive justice.
The case represents a dramatic reversal from the position Tejpal had occupied since 2021, when a Goa Sessions Court acquitted him of all charges. That verdict had been challenged by the Goa government before the Bombay High Court.
On August 6, the Goa bench of the Bombay High Court overturned the Sessions Court's acquittal and found Tejpal guilty of rape and sexual harassment. The allegations relate to an incident in November 2013 involving a junior colleague during Tehelka's ThinkFest event at a resort in Goa.
The High Court sentenced Tejpal to 10 years of rigorous imprisonment. It also imposed fines under the relevant provisions. Although convictions were recorded for multiple offences, the sentences were ordered to run concurrently, meaning the effective maximum imprisonment remains 10 years.
Tejpal had been present when the High Court delivered its verdict. During the proceedings, he sought leniency, referring to his age, family circumstances and the period he had already spent in custody.
The High Court initially granted him four weeks to surrender, allowing him time to seek relief from the Supreme Court. Tejpal subsequently approached the apex court on August 20, challenging the High Court's judgment.
The Supreme Court, however, required him to first surrender before his appeal could proceed.
The controversy erupted in November 2013 when a former Tehelka employee accused Tejpal of sexually assaulting her inside a hotel elevator at a luxury resort in Bambolim, Goa, during the magazine's annual ThinkFest.
Tejpal was arrested on November 30, 2013. He remained in custody for several months before securing bail from the Supreme Court. The trial eventually commenced before a Goa Sessions Court in 2017.
After years of proceedings, the Sessions Court acquitted him in 2021. The Goa government challenged that decision, resulting in a prolonged appellate process before the Bombay High Court.
The High Court's August 6 ruling fundamentally changed the legal status of the case, replacing the earlier acquittal with a conviction and a substantial prison sentence.
The legal proceedings have also taken another turn, with the Goa government approaching the Supreme Court seeking enhancement of Tejpal's sentence to life imprisonment. Importantly, the government has not challenged the High Court's finding that Tejpal is guilty.
This means the Supreme Court will potentially have to consider not only Tejpal's challenge to his conviction but also the government's plea for a harsher sentence.
For Tejpal, the surrender marks the beginning of his prison term but not the end of his legal fight. His decision to continue pursuing remedies before the country's highest court ensures that the case, which has remained in the public spotlight since 2013, will continue to have a significant legal chapter ahead.
