In a significant turn of events ahead of the upcoming Lok Sabha elections, the Centre has informed the Supreme Court that it will refrain from taking coercive action against the Congress party to recover tax dues totaling over ₹3,500 crore. This announcement comes as a relief for the Opposition party, which had approached the apex court after receiving notices from the Income Tax department regarding the hefty tax liabilities.
The matter, which was brought before the Supreme Court, is now scheduled for further hearing on July 24. The Congress had vehemently opposed the tax demands, accusing the ruling Bharatiya Janata Party (BJP) of engaging in "tax terrorism" and attempting to financially suffocate the party in the lead-up to the elections. The Congress also raised concerns about the interference with the level-playing field for the polls and urged the Election Commission to intervene in the matter.
Earlier, the tax authorities had withdrawn a sum of ₹135 crore from the Congress party's accounts towards outstanding dues from previous years. However, during the recent court proceedings, Solicitor General Tushar Mehta assured that no coercive action would be taken against the Congress party during the election period. He clarified that the demand for ₹1,700 crore raised subsequently would be addressed post-elections, indicating a temporary pause in enforcement actions.
Senior Advocate Abhishek Singhvi, representing the Congress, highlighted that the party is not a profit-making organization but a political entity. He emphasized the adverse impact of attaching properties to recover tax dues, particularly in the context of electoral campaigning.
The Supreme Court acknowledged that the issues raised in the appeals are yet to be adjudicated upon and affirmed that the matter would be heard on its merits in due course. The Congress had previously accused the BJP of flouting tax laws with impunity while alleging selective targeting by the Income Tax department.
