Calcutta High Court Takes Suo Motu Cognisance of Sexual Assaults and Land Grabbing in Sandeshkhali

In a distressing turn of events, the Calcutta High Court has taken suo motu cognisance of reports detailing the harrowing ordeal faced by women in Sandeshkhali village, located in the 24 Paraganas district of West Bengal. Shockingly, these reports suggest that women in the village were subjected to sexual assault at gunpoint, and further, tribal lands were being forcibly taken away from villagers. Such egregious violations of human rights and legal norms have prompted swift action from the judiciary.

Justice Apurpa Sinha Ray, expressing profound disappointment, noted the gravity of the situation after examining the disturbing news reports. He highlighted that a significant number of women in Sandeshkhali had allegedly been sexually assaulted under the threat of firearms. The Court, acknowledging the severity of the allegations, decided to take suo motu cognisance over the reported incidents, focusing particularly on the sexual assaults and the unlawful transfer of tribal lands. This proactive stance by the Court underscores its commitment to upholding justice and protecting the rights of vulnerable populations.

To ensure a thorough examination of the matter, the Court appointed advocate Jayanta Narayan Chattopadhyay to assist as an amicus curiae. The case has been scheduled for further hearing on February 20, indicating the Court's intent to delve deeper into the issues at hand and deliver appropriate redressal.

Disturbingly, reports implicate three Trinamool Congress Party (TMC) leaders, namely Sheikh Shajahan, Shiba Prasad Hazra, and Uttam Sardar, in the perpetration of these atrocities. Allegations include their involvement in land grabbing activities and the brutalization of villagers in Sandeshkhali. These serious accusations prompted the scrutiny of another judge of the High Court, Justice Jay Sengupta. Justice Sengupta, in response, quashed an order issued by the district administration under Section 144 of the Code of Criminal Procedure (CrPC), which restricted the movement of people in Sandeshkhali.

The Court was apprised of the disturbing modus operandi employed by the accused TMC leaders, which included the forcible takeover of agricultural land and the exploitation of villagers for labor without fair remuneration. Furthermore, it was revealed that these miscreants would subject women in the village to sexual exploitation within their offices during nighttime.

The deteriorating situation in the village prompted protests by villagers, who took to the streets in front of police stations, expressing their outrage. In a dramatic turn, properties belonging to Uttam Sardar were set ablaze by enraged villagers, compelling authorities to take action. Uttam Sardar, reportedly under arrest following media pressure, stands accused of heinous crimes against the community.

In response to these abhorrent acts, Justice Sengupta expressed deep revulsion, condemning the atrocities perpetrated by the accused TMC leaders. His observations underscore the urgent need for justice and accountability in the face of such egregious violations of human dignity and legal norms.

The actions taken by the Calcutta High Court serve as a beacon of hope for the victims of these heinous crimes, reaffirming the judiciary's unwavering commitment to upholding the rule of law and ensuring justice for all.
